Terms & Conditions of Sale

Effective Date: November 14, 2025

1. Scope

These Terms & Conditions (“Terms”) apply to all purchases made through the Bobber Biotech online store. By placing an order, you confirm your acceptance of these Terms.

2. Definitions

  • “Customer” / “you”: the purchaser of goods from Bobber Biotech.

  • “Goods”: any product offered for sale in the Bobber Biotech shop.

  • “Order Confirmation”: the email you receive from us acknowledging your order. A binding contract is formed at that point.

3. Price & Payment

Prices shown reflect the total cost (product, taxes where applicable, shipping where stated). Payment is required at the time you place an order.

4. Shipping & Delivery

We commit to deliver goods within the timeframe specified at checkout. If we cannot dispatch within that timeframe, we will obtain your consent for a delay or offer a refund.

Risk passes to you once the package leaves our warehouse and is accepted by the carrier.

5. Returns, Refunds & Cancellations

5.1 Defective or Non-Conforming Goods

If the Goods are defective, damaged on arrival, or significantly different from their description, you are entitled to a full refund, replacement, or repair. Federal law (and the requirements of the Federal Trade Commission, FTC) mandates that defects and misrepresentations must be remedied.

5.2 Non-Defective Goods & “No Refund” Policy

  • In the United States, there is no federal law requiring retailers to provide returns or refunds for non-defective goods sold online. Sellers may set their own policy, provided it is clearly disclosed before purchase.

  • Bobber Biotech will accept returns or issue refunds for non-defective Goods only if the return policy is explicitly offered at the point of sale.

  • If a “final sale” or “no refund” policy applies, this must be clearly displayed to you at checkout and on the product page.

5.3 Order Cancellation by Customer

Because most orders involve medical / biologic / sterile products, once the order is confirmed and payment accepted, cancellation is not possible — unless we agree in writing. This is due to regulatory and safety constraints.

6. Order Cancellation by Bobber Biotech

We may cancel your order and refund payment if: the item is out of stock; there was a pricing error or product description mistake; or other unforeseen supply issues arise.

7. Compliance with the Magnuson–Moss Warranty Act & Warranties

If we provide any express warranty on a product, it will meet federal disclosure standards. Even if no warranty is provided, you retain statutory rights for defective or unfit-for-purpose goods per applicable state and federal law.

8. Governing Law & Jurisdiction

These Terms are governed by U.S. federal law and the laws of the state in which Bobber Biotech has its principal place of business.

9. Policy Disclosure & Customer Consent

Our Return & Refund Policy (or “No Refund” policy) must be clearly presented on our website (on the product page, at checkout, and in confirmation email) in order to be legally enforceable.

10. Changes to Terms

Bobber Biotech may update these Terms at any time. Changes apply to new orders only; prior orders remain governed by the version in force at time of purchase.
